Creditor’s Rights

When a borrower, customer, or counterparty files for bankruptcy, creditors face immediate pressure to act — and the decisions made in the early stages of a case often determine the ultimate recovery. We represent creditors through every stage of the bankruptcy process, from filing and prosecuting proofs of claim to litigating complex adversary proceedings.

Our work in adversary proceedings includes disputes involving fraudulent transfers, constructive-fraud claims, and challenges to insider or related-party transactions. We also represent creditors in objections to confirmation where a proposed plan improperly classifies, impairs, or fails to provide fair treatment to creditor claims. These disputes require disciplined attention to the financial record, a clear theory of the case, and the ability to litigate effectively in bankruptcy court.

Because we approach creditors' rights from a litigation perspective, we are able to identify weaknesses in a debtor's position early, build the factual and legal record necessary to support recovery, and apply pressure at the points that matter most.
